General Contest Rules

NO PURCHASE OR OTHER CONSIDERATION IS NECESSARY TO PARTICIPATE; PURCHASE DOES NOT INCREASE CHANCES OF WINNING.
Eligibility
Unless otherwise stated in the specific contest rules, entrants must be at least 18 years old and legal residents of the United States, living or working in the Philadelphia metro survey area (as defined by Nielsen Audio). A winner will be disqualified if he/she or a member of his/her household has won a WMGK contest with a value over $50.00 within the previous 60 days. Winners will also be disqualified if they or a member of their household have won a GREATER MEDIA PHILADELPHIA (WMMR/WMGK/WBEN-FM/WPEN) prize or prize package valued at One Thousand Dollars ($1,000.00) or greater in the past 365 days. Employees (including their immediate families and members of the same household) of Greater Media Philadelphia, its affiliates, promotion sponsors, prize providers, advertising and promotional agencies who do business with WMGK or any of the promotion sponsors/prize providers, and other radio stations in the Philadelphia metro survey area are not eligible to participate. The term “immediate family” includes spouses, siblings, parents and legal guardians, children and legal wards, grandparents, and grandchildren, including “in-laws.” Unless otherwise stated, there is a limit of one entry per person; multiple entries will disqualify the entrant. Void where prohibited.

Internet Contests and Games:
Game and contest participants using the Internet must provide a valid e-mail address. Limit one entry per e-mail address. All contest entries will become the property of Station and will not be acknowledged or returned.
Classic Rock 102.9 WMGK and sponsors not responsible for technical, hardware, software or telephone or other transmission failures of any kind; lost or unavailable network connections; or incomplete, garbled or delayed computer transmissions whether caused by Classic Rock 102.9 WMGK, users, by any equipment or programming utilized in promotions, games or contests, or by human error which may occur in the processing of submissions, which may limit a participant's ability to participate. Classic Rock 102.9 WMGK reserves the right, in its sole discretion, to cancel or suspend a promotion, game or contest should a virus, bug, computer or other problem beyond the control of Classic Rock 102.9 WMGK corrupt the administration, security or proper execution of any Internet promotion, game or contest, or the Internet portion of any Classic Rock 102.9 WMGK promotion, game or contest. Classic Rock 102.9 WMGK, in its sole discretion, may award prizes to entries received by alternate means. All Internet participants agree to be bound by these rules, and the Official General Rules appearing above.


ON-AIR CONTESTS ONLY:

Online listeners to the WMGK web stream may experience a reception delay of up to one minute. Listening to the station’s over-the-air broadcast is the best way to participate in this contest.
When conducting any contest in which listeners are directed to be a certain number caller when a specific song or artist is played, the following rules will apply: snippets of songs played for advertising or promotional purposes and music beds that contain music from the designated artist or song WILL NOT count. Only songs that are played from beginning to end will be used to solicit contest calls. Listeners should try to be the correct caller at 215-263-WMGK as soon as they hear the specific song or artist begin to play. If a listener accidentally calls when a song snippet or music bed is played, s/he will simply be informed of the error; no harm, no foul!
Winner/caller qualification is subject to FULL phone call completion, and the verification of the caller’s name, address, home phone number, work/cell phone number and social security number, all of which must be provided prior to completion of the call. Contest calls will not be accepted at any other number. If caller gets disconnected for any reason before their name and phone number have been recorded, another call will be taken to determine the winner/qualifier.
Any and all Special Programming Features on WMGK are excluded from the contest periods on the radio station. No prizes will be awarded during Special Programming Features.
Special Programming Features on WMGK include: Breakfast With the Beatles from 7am to 9apm on Sundays; Little Steven's Underground Garage from 10pm to Midnight on Sundays.


Text Messaging:

If there is any dispute about the identity of an entrant, the registered user of the text message account on the date of entry will be the recognized entrant. All participants acknowledge that messages are distributed by third-party mobile network providers and WMGK cannot control certain factors relating to message delivery. Participants acknowledge that, depending on the recipient’s mobile provider service, it may not be possible to transmit the message to the recipient successfully. WMGK assumes no responsibility for, and does not guarantee in any way, the availability or performance of any mobile, text or data service, including liability for transmission delays or message failures.

WMGK does not charge a fee for text entries. It is each entrant’s responsibility to check with their individual carrier and mobile/data plan, as other charges may apply. PLEASE BE ADVISED THAT TEXT MESSAGES SENT TO WMGK MAY RESULT IN ONE OR MORE AUTOMATIC BOUNCE BACK MESSAGES, FOR WHICH PARTICIPANTS MAY INCUR A FEE FROM THEIR PROVIDER. WMGK assumes no responsibility for charges incurred for text-messaging, including (without limitation) charges resulting from any bounce back messages or contest notices from the Station.
For texting contests in which entrants are asked to text specific information to a designated telephone line at a particular time or times (as announced by WMGK): At the time that texts are solicited, the criteria for winning will be announced (for example, first text message received with the correct answer). Only those text messages sent to the specific phone number provided, at the time texting is solicited, will be eligible to win. Texting to the main WMGK phone number or any other phone number are not eligible. Winners will be selected in accordance with the criteria announced when text messages are solicited.
For all WMGK texting contests, unless otherwise noted, the texter chosen must answer their phone when called or another winner will be selected.

When participating in our text contests, potential winners will be notified in one of two ways:
(1) if you receive a call from WMGK shortly after texting in, you must pick up the phone or you will be disqualified and another winner will be chosen.
(2) if you are contacted via a bounceback message to be informed that you are a potential winner, you will have 48 hours to provide the station with additional information required to obtain your prize. If you do not provide this info within 48 hours, your prize may be forfeited.

For all texting contests, standard texting charges by your mobile phone carrier may apply; please check your mobile contract for details.
TEXTING - alternative form of entry:
For all WMGK contests that permit listeners to enter by texting the station, listeners will also have the option to enter online at the following URL: www.vibescm.com/amoe . Unless the rules state otherwise, contest entries are limited to one per person for the entire contest, regardless of the entry method. Listeners who enter online will be required to provide the WMGK short code (645645), the contest keyword that the ‘MGK announcer provides on-air and which varies for each contest, and the entrant's first and last name and phone number. For security purposes, online entrants will be required to enter the code word(s) shown on the entry page before completing their entry. All web and text entries will be pooled together and a winner(s) will be chosen from that pool in accordance with the contest rules.

Prizes

Unless otherwise stated, or where winners are chosen at the Station’s discretion, odds of winning depend on number of eligible entries received. Non-cash prizes are not redeemable for cash. WMGK reserves the right, in its sole discretion, to substitute any prize with one of equal or greater value. Winners may not request prize substitution. Prizes are non-transferable and may not be claimed or used by any person other than the winner. Taxes, gratuities and all other incidentals are the sole responsibility of the winner. If the prize is tickets to a performance or event, WMGK is not responsible for cancellations due to weather, promoter or performer, and is not obligated to provide an alternate prize.
Unless an earlier date is specified in the rules, all prizes must be claimed within thirty days of the date won or the prize will be forfeited. Office hours are Monday through Friday 9am-5pm, but may close early before holidays. Please call 610-667-8500 to confirm that the office is open before attempting to claim prize. If approved by WMGK in advance and subject to completion of all required paperwork, winners may appoint someone to pick up their prize for them. If they do so, that person must present a copy of the prize winner's VALID, GOVERNMENT ISSUED ID or the prize cannot be released. All prizes MUST be picked up at the WMGK offices during office business hours unless otherwise noted.

Release
By entering the contest, all participants release and hold harmless the promotion sponsors, WMGK, Greater Philadelphia Radio, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents from any and all liability and any injuries, loss or damage of any kind arising from or in connection with this contest and any prize won. Winners (and their guests, if any) will be required to sign an affidavit and liability/publicity release, releasing WMGK and its affiliated companies from all liability in connection with the contest and the award and use of the prize, before claiming the prize.
Disclaimer
WMGK undertakes no liability or responsibility, and makes no warranties, express or implied, with respect to the performance of any prize(s) awarded, for any failure to perform or negligent performance of any service provider, or for any other risk, incident or damage, direct or indirect, relating to or arising out of the contest, including (but not limited to) cancellations, postponements, delays or other scheduling changes; missed events or connections or inability of winner to attend; and accident, injury, death, damage or expense arising from or occurring during the use of the prize, or travel to/from or attendance at any event relating to the contest, by the winner and/or winner’s guest(s). WMGK is not responsible for damage to a prize or loss of a prize after the prize has been claimed. Winners must inspect their prizes before leaving the station. WMGK is not responsible for technical, hardware or software failure or malfunctions, lost or unavailable network or other telecommunications connections, or lost, late, misdirected, damaged, illegible, inaccurate, incomplete, garbled, disconnected, or delayed contest entries or communications, whether caused by the sender or by any of the equipment or programming associated with or used in this contest, or by any human error which may occur in the execution of the contest. If, for any reason, the contest is not capable of being conducted as planned, including but not limited to infection by computer virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond the control of WMGK, station management reserves the right at its sole discretion to cancel, terminate, modify or suspend the contest and/or determine an alternate method of awarding the prize(s).
License
Entry into any contest constitutes full permission for WMGK and promotion sponsors/prize providers and their respective affiliates to broadcast and/or to photograph or publish the participant's name, voice, recorded comments, biographical information, face and likeness, in any medium, without compensation.
Taxes
If required by applicable law, WMGK will report the total value of each prize to the IRS and will furnish winners with a federal Form 1099. Winners must provide their social security number to WMGK for tax reporting purposes, and are solely responsible for payment of all taxes incurred as a result of the award of a prize.
General
Failure to conform to all contest rules, or any fraud or other illegal or inappropriate conduct on the part of a contestant or on a contestant’s behalf, will result in the contestant's disqualification and forfeiture of any prize won. WMGK reserves the right to rule ineligible listeners who, in WMGK’s sole judgment, engage in abusive conduct with respect to any contest or promotion conducted by WMGK or its affiliates. WMGK reserves the right to cancel, suspend and/or modify this Contest and these Official Rules at any time, which changes will become effective upon announcement. By taking part in this contest, participants agree to be bound by these rules and all decisions of the judges, who are employees of WMGK and whose decisions with respect to all aspects of the contest are final and binding. Copies of written contest rules and, where required by law, the list of winners are available during regular business hours at the WMGK studio, One Bala Plaza, Suite 339, Bala Cynwyd, PA 19004, for 60 days after the contest concludes.
As a condition to participating in the Contest, each entrant agrees that any and all disputes that cannot be resolved between the parties, and all causes of action arising out of or in connection with the Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in Philadelphia, Pennsylvania, having competent jurisdiction, which court shall apply the laws of the Commonwealth of Pennsylvania, without regard to the conflicts of law principles thereof. The entrant and WMGK hereby waive any and all right to trial by jury. If any provision of these Rules is declared or found by a court of competent jurisdiction to be illegal, unenforceable or void, then such provision will be null and void but each other provision hereof not so affected will be enforced to the full extent permitted by applicable law.

WMGK’S TRANS-SIBERIAN ORCHESTRA IN ORLANDO

CONTEST RULES TEMPLATE

 

These rules apply to WMGK’s Trans-Siberian Orchestra In Orlando Contest (“Contest”) conducted by Beasley Media Group, Inc. d/b/a WMGK (“WMGK” or “Station”). In addition, the General Contest Rules attached hereto and posted at Station’s website apply to this Contest. If there is a conflict between the General Contest Rules and the Rules for this Contest, the Rules for this Contest shall control.

 

1.                  HOW TO ENTER AND PLAY

 

a.       The Contest will begin on Monday, September 11, 2017 at 6:00am Eastern Time (“ET”) and end on Friday, September 15, 2017 at 11:59pm ET (“Contest Period”).

 

b.      Each weekday listen for the WMGK DJ to tell you when to call 215-263-WMGK (9645) to answer a question or when to be the correct caller at 215-263-WMGK (9645) for the chance to win a pair of tickets to see Trans-Siberian Orchestra’s concert on December 17, 2017 at 7:30pm at Wells Fargo Center.  All ticket winners will be qualified to win a two night trip for two to Orlando, Florida and tickets to see Trans-Siberian Orchestra on December 16, 2017 at Amway Center .
c.       In the event that the selected caller does not correctly answer the question, is disconnected or is found to be ineligible, the next eligible caller who successfully makes it through on the call-in line and completes the call, including correctly answering the question, will be a qualifying prize winner.  There is no limit to the number of times a listener may attempt to call in to win, but a listener may be a qualifying prize winner only once.

 

d.      There will be up to fifteen (15) qualifying prize winners and one (1) grand prize winner selected via a random drawing at the end of the Contest Period.

 

e.       Due to delays in the online streaming of the Station’s broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests.  Entrants are encouraged to listen to the Station on-air.  The Station is not responsible for online streaming delays.

 

 

2.                  ELIGIBILITY RESTRICTIONS

 

a.       This Contest is open to all Station listeners who 21 years of age or older as of the date of entry into the Contest, who are legal US residents and reside in reside in a PA, NJ, or DE county that is part of Station’s terrestrial listening area, except void where prohibited by law.  Contestants must possess a valid, government-issued ID. Winners must possess a valid, government-issued ID and show proof of residency to verify eligibility.

 

b.      Winner and guest must both be 21 years of age or older.

 

3.                  PRIZES

 

a.       Up to fifteen (15) qualifying prizes will be awarded.  Each qualifying prize is two (2) tickets to see Trans-Siberian Orchestra on December 17, 2017 at Wells Fargo Center in Philadelphia.  Approximate Retail Value (“ARV”) of Prize is $70.

 

b.      One (1) grand prize will be awarded:  the grand prize is a trip for two (winner and one (1) guest aged 21+) and includes the following:

 

(i)                 Two (2) roundtrip, coach class tickets/vouchers to Orlando, Florida departing Philadelphia on December 16, 2017 and returning on December 18, 2017. Airline To Be Determined.  Winner is responsible for all associated baggage fees.

(ii)               (ii) two nights hotel accommodations – check in on December 16, 2017 and Check out on the morning of December 18, 2017 in Orlando, Florida.  Exact hotel to be determined.  (one room, standard/double occupancy) . Winner is responsible for paying for transportation to and from hotel and concert venue.

 

(iii)             (iii) two (2) tickets courtesy of LiveNation to see Trans-Siberian Orchestra on December 16, 2017 at Amway Center (8p).

 

Grand prize ARV is $580.  Actual value may vary and any difference between stated value and actual value will not be awarded.  Airline reservations /Hotel subject to availability. Certain travel restrictions may apply.  All other costs not specifically stated herein, including but not limited to those of, taxes, meals, tips and ground transportation are the responsibility of the winner.  Airline regulations apply.  If applicable, the winner may be required to present a valid credit card upon hotel check in to cover any incidental expenses incurred during the winner’s stay.  The winner and guest must sign all required Releases prior to traveling.  Any voucher will be subject to the terms and conditions as set forth by its issuer. Vouchers are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will they be replaced if lost or stolen.  If a prize-related event or travel is unable to take place as scheduled, for reasons such as cancellation, preemption, postponement or unavailability, including for weather, or for any reason beyond the control of the Station, their sole responsibility to the winner will be to award the remaining available elements of the prize(s) and no substitution or compensation will be provided for the unawarded elements of the prize(s).  No refund or compensation will be made in the event of the cancellation or delay of any flight.
c.       Winner must contact booking agent listed on certificate at least 4 weeks in advance of their requested travel dates.

 

d.      Winner must confirm their ability to take the trip by no later than September 22, 2017 or their grand prize may be rescinded and the trip may be awarded by random drawing from remaining qualifiers.  The other qualifier will have 5 business days to confirm receipt of the trip. If that qualifier does not do so, the trip will be offered to another qualifier. Winner and guest are responsible for all meals, associated fees, parking, entertainment, etc other than the items listed above.

e.       Winner must sign all pertinent tax paperwork and release forms by no later than November 27, 2017 or the trip may be rescinded.  Forms must be signed at the office of the Station located at One Bala Plaza, Suite 339, Bala Cynwyd, PA 19004, Monday-Friday, during regular business hours. Qualifying Prize or prize certificate must be claimed within thirty (30) days of winning.  Failure to claim any prize by the specified time will result in forfeiture of the prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in these Official Rules.

 

4.                  SELECTION OF WINNERS

 

a.       Up to fifteen (15) qualifying prizes will be awarded as described in Section 1 of these rules. One (1) grand prizewinner will be randomly selected at approximately 12pm ET on Monday, September 18, 2017 ET from all valid qualifying prize winners.

 

b. Potential qualifying prize winner(s) will be notified of winning at the time of their winning phone call.  The potential grand prizewinner will be notified by telephone promptly following his/her selection in the random drawing.

 

b.      Odds of winning a qualifying prize depend upon the number and order of calls received.  Odds of a qualifying prizewinner winning the grand prize are up to 1 in 15.

 

c.       Entrants must listen to the Station to win but need not be present to win.

 

5.                  CONDITIONS

 

See Attachment A “General Contest Rules” for additional conditions.

 

a.   The Station reserves the right to end any contest or amend these rules upon announcement on air and by publication at www.wmgk.com.

b.   For website contests: By use of the Station’s website and by entering this Contest, contestants agree to the Station’s Terms of Service Agreement and to the use of Personal Information as stated in the Privacy Policy located at www.wmgk.com.

c.   Copies of the written contest rules and a list of all winners are available during regular business hours at the main studio of the Station, address, city, state, zip, or by sending a self-addressed, stamped envelope to the Station.

BEASLEY MEDIA GROUP, INC.

GENERAL CONTEST RULES

 

These rules apply to all contests conducted by Beasley Media Group, Inc.’s radio stations. Station specific contests will have their own specific rules which will be set forth in contest rules for that particular contest and will be available at the Station studio and on the Station’s website. If there is a conflict between these General Contest Rules and the Rules for a specific Contest, the Rules for the specific Contest shall control.

 

1. HOW TO ENTER AND PLAY
a. Unless otherwise noted, one entry per person will be accepted. In the event multiple entries are allowed, each entry must be submitted individually. Mechanically reproduced or software generated entries of any kind will not be accepted. Any materials submitted become the property of Station and will not be returned.

2. ELIGIBILITY RESTRICTIONS
a. Unless otherwise specified, contests are open to all listeners who are 21 years of age or older and who reside in the service area of station.  Contestants must possess a valid, government-issued ID. Winner must show proof of residency to verify eligibility.

b. Employees of Station, its licensee, its parent corporation and their affiliated entities, advertising and PR agencies, participating sponsors/promotional partners, other radio stations in the service area of the station and the members of their immediate families are ineligible to participate or win.

c. Unless otherwise specified, Listeners are eligible to win Beasley Media Group contests only once every sixty (60) days and a prize valued at $600 or more, only once every six months.  Only one winner per household (whether related or not) is permitted in any contest.

3. PRIZES
a. Unless otherwise specified by the Station, all prizes or prize certificates must be claimed at the office of the Station conducting the contest  Monday-Friday, during regular business hours.  Prize or prize certificate must be claimed within thirty (30) days of winning.  Failure to claim prize by the specified time will result in forfeiture of the prize.

b. Unless otherwise permitted by the Station, winner(s) must claim his or her Prize in person, and a Prize cannot be claimed by third parties on behalf of the winner. If a contest is open to entrants under the age of 18 and a winner is under the age of 18, a parent or legal guardian must claim the Prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in the official rules of the contest.

c. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. The Station is not responsible for the safe arrival of a prize or prize certificate.

d. Prizes are not transferable. Prizes may not be substituted for or redeemed for cash.

4. SELECTION OF WINNERS

a. Contest winners will be selected and notified of their prize in the manner announced by the Station.

b. Unless otherwise specified, if the winner(s) cannot be contacted within 24 hours after the prize is awarded, an alternate winner may be selected at the Station’s discretion. Unless otherwise specified, winners who fail to respond within 24 hours of prize notification are deemed to be waiving their prize claim and the prize will be forfeited.

c. The odds of winning depend upon the number of eligible entries received or the relative performance of each contestant.

5. CONDITIONS

a. WARNING: Online listeners to streamed broadcasts may experience a lag in transmissions.

b. Taxes and Liability: Payment of all federal, state and local taxes is the sole responsibility of the winner. Contest winnings will be reported to the Internal Revenue Service and winners can expect to receive a 1099 tax form for prizes which total more than $600 for the calendar year. Winners may be required to accurately complete and submit IRS Form W-9 to the Station as a condition of acceptance of a prize.

c. By participating in the contest, contestant agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation.

d. By participating in the contest, contestants hereby releases and agrees to indemnify and hold harmless the Station, its licensee, affiliates, subsidiaries, parent corporation and each of their officers, directors, shareholders, employees, advertising and PR agencies, sponsors, advertisers, promotional partners, agents, representatives, and their successors and assigns, and all others connected with them and the contest (collectively, “Released Parties”) from any and all liability, claims, actions and damages sustained or incurred by participation in the contest and the receipt and use of any prize awarded (if any) through such contest arising in any manner whatsoever.

e. Contest winners (and their guests or travel companions, if any) may be required in the Station’s sole discretion, to sign a liability release and a publicity release. A winner (or his/her parent or legal guardian if under the age of 18 years) must execute and return any required release within five (5) business days from notification or winner will be disqualified and the prize will be forfeited. An alternate winner may be chosen by random selection. Pursuant to the liability release, the winners will agree to hold the Released Parties harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. Any contestant (or his/her parent or legal guardian, if applicable) who refuses to sign any required release will forfeit any and all prizes.

f. The Station will be excused from its obligation to conduct the contest if its performance is delayed or prevented due to causes beyond its control, including, but not limited to acts of God, public enemies, war, civil disorder, fire, flood, hurricanes, explosion, labor disputes or strikes, and any acts by any governmental authority.

g. The Station, its licensee, affiliates, subsidiaries, parent corporation, sponsors, advertisers and promotional partners, and their assigns and successors are not responsible for failure to conduct or for alterations to the contest due to circumstances beyond the control of any such entity.

h. Decisions of Station management with respect to the contest are final.

i. The Station reserves the right to end any contest or amend these rules upon announcement on air or publication on the Station website.

j. The Station reserves the right to make changes to the rules of the contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.

k. The Station is not responsible for any prizes or certificates lost or stolen after the winner has claimed them from the Station.

l. Prizes are awarded ‘as is’ with no guarantees or warranties as to use. Acceptance of a prize releases the Station, its sponsors, promotional partners and advertisers from all liability and claims concerning the prize, its delivery, and its use.

m. The Station is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize. The Station is not responsible for (i) lost, stolen, mutilated, misdirected, postage due, illegible, incomplete or late entries; (ii) telephone or mobile service outages, delays, busy signals, facsimile transmission errors, equipment malfunctions and any other technological difficulties that may prevent an individual from completing his/her telephone call or from sending a text message (if applicable, message and data rates may apply, and the Station is not responsible for any fees incurred by an entrant for this method of entry); (iii) entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technical difficulties.

 

n. By participating in this contest, contestants agree to be bound by these rules. Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of the Station.

o. Contestants are required to provide truthful information as part of their entry and the Station will reject and delete any entry that it discovers to be false or fraudulent. The Station will disqualify any entry from contestants who do not meet the eligibility requirements and the Station will also delete any online entry if it learns that it was submitted by any contestants under the age of 13.

p. No purchase is necessary. The contest is void where prohibited. Contests and promotions are subject to all federal, state and local laws.

q. For website contests: By use of the Station’s website and by entering this Promotion, contestants agree to the Station’s Terms of Service Agreement and to the use of Personal Information as stated in the Privacy Policy located on the Station website.

Each contestant’s photo and/or video entry must be his/her original creative work and/or property and must not contain copyrighted materials or any other materials, which may be restricted, prohibited, or outlawed by Federal, state or local laws.  Contestants are required to obtain a written release from all individuals appearing in the photo and/or video which grants, the right to use their name, likeness and recorded voice and the right to post the video on the Station’s website for the general public to view.  Each contestant agrees to hold the Station(s), Beasley Media Group, Inc., its parent companies, its subsidiaries, their affiliated entities, and their respective shareholders, officers, directors, agents, representatives, employees, and all of their successors and assigns harmless against any and all claims or liability arising directly or indirectly from the prize and/or contest, including but not limited to an infringement or alleged infringement of any intellectual property, publicity or privacy right, or violation of any law or regulation, involving the photo and/or video entry.

12. FOR CONTESTS PROMOTED ON STATION FACEBOOK PAGE

a. This Contest is in no way sponsored, endorsed or administered by, or associated with Facebook. By submission of an entry, a contestant releases Facebook from any responsibility or liability of the Contest’s administration, prizes or promotion. Contestants are providing entry information to the Station and not to Facebook.

13. For CONTESTS PROMOTED ON Instagram

WMGK’S  RON’S DISCOUNT TIRES CONCERT  GIVEAWAY

 

These rules apply to WMGK’s Hershey Park Giveaway Contest (“Contest”) conducted by Beasley Media Group, Inc. d/b/a WMGK (“Station”). In addition, the General Contest Rules attached hereto and posted at Station’s website apply to this Contest. If there is a conflict between the General Contest Rules and the Rules for this Contest, the Rules for this Contest shall control.

 

1.                  HOW TO ENTER

 

a.       The Contest will begin on Monday, September 18, 2017 and end on Friday, December 29, 2017 (“Contest Period”).
b.      Interested contestants should go to Ron’s Discount Tires, located at 1702 Naamans Rd, Wilmington, DE 19810, during business hours and fill out a registration form (available while supplies last).  All entries must include:  First and Last name; Address, Date of Birth; Phone number. Failure to provide all required information may result in disqualification. Entry deadline is Friday, December 29, 2017 at 11:59am.

 

c.       Limit one (1) entry per person. Nonwinning entries each month will be rolled over to any future drawings. One entry per month is permitted. There will be up to a total of four (4) prize winners selected in the Contest.  Entry deadline each month is 11:59am on the day of the drawing (dates listed below).

 

 

2.                  ELIGIBILITY RESTRICTIONS

 

a.       This Contest is open to all Station listeners who 18 years of age or older as of the date of entry into the Contest, who are legal US residents and reside in reside in a PA, NJ, or DE county that is part of Station’s terrestrial listening area, except void where prohibited by law.  Contestants must possess a valid, government-issued ID. Winners must possess a valid, government-issued ID and show proof of residency to verify eligibility.

 

3.      PRIZES

 

a.       Four (4) prizes will be awarded (one in September, one in October, one in November, one in December).  Each prize is two (2) tickets (for winner and one (1) guest) to attend an upcoming concert at the Grand Opera House in Wilmington, DE.  The Approximate Retail Value (“ARV”) of the prize: $40.00. Event tickets will be for an event that is at least seven (7) days in advance of when the winner is notified, if not more. Tickets will be subject to the terms and conditions as set forth by its issuer. Tickets are not refundable or transferable, and may not be substituted or exchanged for cash or credit at any time, nor will they be replaced if lost or stolen.

 

b.      Prizes or prize certificates must be claimed at the box office of Grand Opera House in Wilmington, DE 90 minutes before showtime. Failure to claim Prize by the specified time will result in forfeiture of the prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in these Official Rules.

 

 

4.      SELECTION OF WINNERS

 

a. At approximately 12pm Eastern Time (“ET”) on each of the following dates : September 29, 2017; October 27, 2017, the November 29, 2017 and  December 29, 2017, the WMGK and Ron’s Discount Tire staff will chose one (1) prize winner at random from all entries received up until 11am on the dates listed. Each prize winner will be contacted by phone promptly following the drawing. Initially selected winner will have two (2) business days to confirm prize. If initially selected winner does not respond back to Station within (2) two business days, another winner may be selected at random form the remaining entries for that drawing If the alternate winner does not respond back within two (2) business days, the Station may choose another winner or elect to rescind the prize for this prize drawing. One entry per person per month, multiple entries per month may result in disqualification.

 

b.      Odds of winning depend upon the number of entries received for each monthly drawing.

 

c.       Entrants are not required to listen to the Station but must be present to enter but not for the prize drawing(s).

 

d.      Decisions of Station management with respect to the Contest are final.

GENERAL CONTEST RULES

 

These rules apply to all contests conducted by Beasley Media Group, Inc.’s radio stations. Station specific contests will have their own specific rules which will be set forth in contest rules for that particular contest and will be available at the Station studio and on the Station’s website. If there is a conflict between these General Contest Rules and the Rules for a specific Contest, the Rules for the specific Contest shall control.

 

1. HOW TO ENTER AND PLAY
a. Unless otherwise noted, one entry per person will be accepted. In the event multiple entries are allowed, each entry must be submitted individually. Mechanically reproduced or software generated entries of any kind will not be accepted. Any materials submitted become the property of Station and will not be returned.

2. ELIGIBILITY RESTRICTIONS
a. Unless otherwise specified, contests are open to all listeners who are 21 years of age or older and who reside in the service area of station.  Contestants must possess a valid, government-issued ID. Winner must show proof of residency to verify eligibility.

b. Employees of Station, its licensee, its parent corporation and their affiliated entities, advertising and PR agencies, participating sponsors/promotional partners, other radio stations in the service area of the station and the members of their immediate families are ineligible to participate or win.

c. Unless otherwise specified, Listeners are eligible to win Beasley Media Group contests only once every sixty (60) days and a prize valued at $600 or more, only once every six months.  Only one winner per household (whether related or not) is permitted in any contest.

3. PRIZES
a. Unless otherwise specified by the Station, all prizes or prize certificates must be claimed at the office of the Station conducting the contest  Monday-Friday, during regular business hours.  Prize or prize certificate must be claimed within thirty (30) days of winning.  Failure to claim prize by the specified time will result in forfeiture of the prize.

b. Unless otherwise permitted by the Station, winner(s) must claim his or her Prize in person, and a Prize cannot be claimed by third parties on behalf of the winner. If a contest is open to entrants under the age of 18 and a winner is under the age of 18, a parent or legal guardian must claim the Prize. It is the winner’s sole responsibility to claim the Prize or prize certificate within the timeline provided in the official rules of the contest.

c. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival. The Station is not responsible for the safe arrival of a prize or prize certificate.

d. Prizes are not transferable. Prizes may not be substituted for or redeemed for cash.

4. SELECTION OF WINNERS

a. Contest winners will be selected and notified of their prize in the manner announced by the Station.

b. Unless otherwise specified, if the winner(s) cannot be contacted within 24 hours after the prize is awarded, an alternate winner may be selected at the Station’s discretion. Unless otherwise specified, winners who fail to respond within 24 hours of prize notification are deemed to be waiving their prize claim and the prize will be forfeited.

c. The odds of winning depend upon the number of eligible entries received or the relative performance of each contestant.

5. CONDITIONS

a. WARNING: Online listeners to streamed broadcasts may experience a lag in transmissions.

b. Taxes and Liability: Payment of all federal, state and local taxes is the sole responsibility of the winner. Contest winnings will be reported to the Internal Revenue Service and winners can expect to receive a 1099 tax form for prizes which total more than $600 for the calendar year. Winners may be required to accurately complete and submit IRS Form W-9 to the Station as a condition of acceptance of a prize.

c. By participating in the contest, contestant agrees to have his or her name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation.

d. By participating in the contest, contestants hereby releases and agrees to indemnify and hold harmless the Station, its licensee, affiliates, subsidiaries, parent corporation and each of their officers, directors, shareholders, employees, advertising and PR agencies, sponsors, advertisers, promotional partners, agents, representatives, and their successors and assigns, and all others connected with them and the contest (collectively, “Released Parties”) from any and all liability, claims, actions and damages sustained or incurred by participation in the contest and the receipt and use of any prize awarded (if any) through such contest arising in any manner whatsoever.

e. Contest winners (and their guests or travel companions, if any) may be required in the Station’s sole discretion, to sign a liability release and a publicity release. A winner (or his/her parent or legal guardian if under the age of 18 years) must execute and return any required release within five (5) business days from notification or winner will be disqualified and the prize will be forfeited. An alternate winner may be chosen by random selection. Pursuant to the liability release, the winners will agree to hold the Released Parties harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. f. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN (EXCEPT MESSAGE AND DATA RATES MAY APPLY).  A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.  OPEN TO LEGAL RESIDENTS OF THE FIFTY (50) UNITED STATES AND WASHINGTON, DC, WHO ARE 18 YEARS OF AGE OR OLDER AT TIME OF ENTRY.  VOID WHERE PROHIBITED.

1.                  DESCRIPTION:  The Beasley Media Group Fall 2017 Nationwide Contest (“Promotion”) begins on Monday, September 18, 2017, and will run through Friday, October 27, 2017.  The Promotion is being conducted by Beasley Media Group Inc. and its participating radio stations (the “Stations”) as listed below.  The Promotion, known as “The 1K Giveaway” on the Stations, will begin on Monday, September 18, 2017, and will run through Friday, October,27 2017, weekdays between the hours of 5am Pacific Time (“PT”) / 8am Eastern Time (“ET”) and 3:20pm PT / 6:20pm ET (“Promotion Period”).

3.                  ADMINISTRATOR:  Beasley Media Group Inc., 3033 Riviera Drive, Suite 200, Naples, FL 34103

4.                  ELIGIBILITY:  The Promotion is open only to legal residents of the fifty (50) United States and District of Columbia (U.S.) who are at least eighteen (18) years of age or the age of majority in their state of residence, whichever is older as of date of entry (“Contestant”). Contestants will be competing with listeners from approximately forty five (45) radio stations in multiple radio markets across the United States.  Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of Beasley Media Group, Hipcricket Corporate and Promotion sponsors (if any), and their respective parent companies, subsidiaries, distributors, affiliates, service providers, advertising and promotion agencies and companies involved in the design, implementation and execution of the Promotion (collectively the “Promotion Entities”), other radio stations in the metropolitan areas of the participating stations and members of their immediate families (parents, children, siblings, spouses) or persons living in the same households as such persons, whether related or not, are not eligible to participate or win. This Promotion is governed by Florida law and is subject to all federal, state and local laws and regulations.  Promotion is void in Puerto Rico, and US Territories and jurisdictions (including overseas military installations) and where prohibited.  Contestants are required to provide truthful information and Beasley Media will reject and delete any entry that it discovers to be false or fraudulent.  Beasley Media will disqualify any entry from individuals who do not meet the eligibility requirements and will also delete any entry as required by law.

5.                  AGREEMENT TO THE OFFICIAL RULES:  By participating in the Promotion, each participant fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Administrator, which are final and binding in all matters related to the Promotion. Winning the prize is contingent upon fulfilling all requirements set forth herein.

6.                  HOW TO ENTER:  There are two (2) ways to enter.  Contestants may enter online or via text entry as follows:

a.                   To participate in the Promotion, Beasley Media Group station listeners will need to listen to a participating Station each weekday during the Promotion Period at 8am, 11am, 1pm, 4pm, 6pm eastern time or 5am, 8am, 10am, 1pm, 3pm pacific, when at each time a Cue will be announced.  The Cue will include a unique Key Word.  Upon hearing the Cue, enter by texting the Key Word to 40772 on a mobile phone or by entering online no later than fifteen (15) minutes after the start of the hour during which the Cue is announced to be entered for a chance to win a $1,000 cash prize.

b.                  On each weekday throughout the Promotion, five (5) potential nationwide prize winners will be randomly selected – (i) one (1) between the hours of 5:00 a.m. PT / 8:00 a.m. ET and 5:15 a.m. PT / 8:15 a.m. ET.  (ii) one (1) between the hours of 8:00 a.m. PT / 11:00 a.m. ET and 8:15 a.m. PT / 11:15 a.m. ET.  (iii) one (1) between the hours of 10:00 a.m. PT / 1:00 p.m. ET and 10:15 a.m. PT / 1:15 p.m. ET.  (iv) one (1) between the hours of 1:00 p.m. PT / 4:00 p.m. ET and 1:15 p.m. PT / 4:15 p.m. ET.  (v) one (1) between the hours of 3 p.m. PT / 6:00 p.m. ET and 3:15 p.m. PT / 6:15 p.m. ET.  A total of one hundred fifty (150) Prizes will be awarded during the Promotion Period.  Beasley Media Group participating stations may also announce exact times that future Cues will be played.  Station listeners will be entering along with listeners from other stations around the country who will also receive the Key Word announcements at similar times and will be entering before the same Entry Period deadline for each Cue.

c.                   Each entry window shall close at the start of the fifteenth (15th) minute after the top of the hour in which the Cue is announced, regardless of when the Cue airs (each, an “Entry Period”).  Each participating station reserves the right to announce the Cue between the first one (1) and fifteen (15) minutes of the hour.  Following each Entry Period, Beasley Media will conduct a random drawing from among all mobile phone and online entrants who provided the correct Key Word nationwide during that Entry Period (the “Entry Period Pool”), and one (1) potential nationwide $1,000 cash prize winner will be randomly selected and called by Beasley Media promptly following his/her selection.  Only one (1) entry per person, per Cue is permitted regardless of the method of entry.  The randomly selected Contestant must be available at the time of Beasley Media’s call to be eligible to win the prize.  Once reached by phone, the randomly selected Contestant will be deemed the potential $1,000 cash prize winner (upon confirmation of eligibility).  At the time of the call, the potential prize winner will be required to provide all information requested to verify eligibility.  Information requested includes their full name, complete address (including zip code), day and evening phone numbers and date of birth.  Beasley Media will attempt to call the randomly selected entrant five (5) times shortly following the random drawing for the applicable Entry Period.  No voicemail message will be left.  If the potential prize winner fails to answer the calls or is disconnected or is otherwise found to be ineligible, the prize will be forfeited and the Station will randomly select another entrant from the same Entry Period Pool to be the potential $1,000 prize winner.  This will continue until the $1,000 prize is awarded in that hour (time permitting).  By participating in the Promotion entrants consent to Beasley Media contacting them by phone at the telephone number from which the mobile entry was received or as indicated by the entrant on the online entry form.  Any and all fees arising out of the transmission of or receipt of a mobile call shall solely be the responsibility of the entrant.  Message and data rates may apply per the entrant’s carrier.  By participating in the Promotion via mobile entry, entrants acknowledge that text messages are connected and transmitted through third party providers; Beasley Media does not guarantee, and shall not be responsible for, the connection or timeliness of any such text messages.

d.                  To enter via Mobile Phone/Device:  To enter by mobile phone, upon hearing the Cue, text the day’s Key Word to 40772 during the Cue’s Entry Period.  Message and data rates may apply.  Promotion Entities are not responsible for any fees or charges incurred for and associated with mobile entries.  The text message entry method is designed to work with most of the major wireless carriers in the United States, but the Promotion Entities make no guarantee that any particular wireless service provider will participate.  Entrants should check their phone’s features to see if they have that capability.  Entrants should consult their wireless service provider’s pricing plan for details.  Entry by text message will not improve your chance of winning.  By entering via text, each entrant consents to receive up to five (5) notification phone calls on their provided phone number if randomly selected as a potential winner.  Further, by entering by text message, entrants agree to accept all applicable charges associated therewith.

e.                   To enter via Online Entry:  To enter online, upon hearing the Cue visit the Station’s website and follow the links and instructions to enter the Promotion and complete and submit the online entry form during the respective Entry Period following the Cue.  By entering online, each entrant consents to receive up to five (5) notification phone calls on their provided phone number if randomly selected as a potential winner.  Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry.  The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning an email address or the domain associated with the submitted email address.  Multiple participants are not permitted to share the same email address.  Online entries submitted may not be acknowledged or returned.

f.                   Entrants may enter only once per Entry Period, regardless of the method of entry (i.e., only one (1) entry per person per Cue).  Additional entries will be disqualified by the Promotion Entities solely at their discretion.  A listener may only win one $1,000 cash prize during the Promotion, and only one $1,000 cash prize winner per household is permitted during the Promotion Period.  For this Promotion only, restrictions that would prevent a listener from winning if he/she had won another recent Beasley Media station contest or promotion will not apply.  Use of any device to automate entry is prohibited.  Proof of submission of an entry shall not be deemed proof of receipt by Beasley Media.  Beasley Media’s computer is the official time keeping device for the Promotion.  Any attempt by any Contestant to obtain more than the stated number of entries by using multiple/different identities, registrations or any other methods will void that participant’s entries and that Contestant may be disqualified.

g.                  In the event of an equipment malfunction, Beasley Media reserves the right to award prize to a randomly selected entrant from the immediately prior Entry Period pool, except that any such Contestant who was awarded the prize for such Entry Period will be excluded.  Given the volume of participation, Contestants may experience an inability to access website to enter.

h.                  Online listeners to streamed broadcasts may experience a lag in transmissions due to buffering limitations. Entrants should not rely on streamed broadcasts to participate in any contest as they may be disadvantaged when participating in on-air contests.  Entrants are encouraged to listen to the Station for the Cues on-air.  The Promotion Entities are not responsible for online streaming delays or outages.

7.                  PRIZES: No more than the advertised number of prizes shall be awarded. A prize may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash except in the Promotion Entities’ sole discretion. Prize details and availability are subject to change. There are no substitutions unless specified by Beasley Media and Beasley Media reserves the right to substitute any prize (or prize component) with another prize (or prize component) of equal or greater value at its sole discretion. Prizing may be fulfilled by a third party fulfillment company. The Promotion Entities are not in any way responsible or liable for damages resulting from shipping and handling, loss, use or misuse of any prize awarded in this contest. The prize is awarded if properly claimed according to the Rules and if there are sufficient eligible entries. All other costs and expenses related to prize acceptance and use not specified herein as being provided are the sole responsibility of winner(s). If the winner is disqualified or is found to be ineligible for the contest, Beasley Media reserves the right to determine an alternate winner or not to award the prize, at its sole discretion. Each Prize is $1,000 cash (in the form of a check made payable to the prize winner upon confirmation of his/her eligibility).  The Station may award up to one hundred and fifty (150) total Prizes for an approximate total retail value for the Promotion of $150,000.  Each cash prize will be issued as a check payable to the order of the prize winner upon verification of eligibility and upon timely receipt of all completed prize winner paperwork.  Checks will be processed and mailed within four to eight weeks upon verification of eligibility and receipt of all completed prize winner paperwork.  All taxes, including but not limited to, federal, state, and local taxes, and any other costs and expenses associated with the acceptance and use of a prize are solely the responsibility of the winner.  The prize winners will each be issued an IRS Form 1099 for the value of their respective prize(s).

8.                  WINNER SELECTION:  Potential $1,000 cash prize winners will be determined as described above and will be notified by telephone beginning approximately fifteen (15) minutes following each Entry Period.  Listeners from approximately forty five (45) radio stations in multiple radio markets across the United States will be participating at the same time(s).  Odds of being selected as a $1,000 cash prize winner depend on the combined number of entries received from all markets.  Decisions of Beasley Media with respect to the Promotion are final.

9.                  WINNER NOTIFICATION:  Beasley Media may notify potential prize winners by telephone with follow up correspondence by email, U.S. Mail and/or courier. Winners must execute and return any required affidavit of eligibility and/or liability/publicity release within five (5) days of notification attempt or prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

10.              CONDITIONS

a.                   By participating, Contestants agree to:  (a) release Promotion Entities, their respective directors, officers, agents and employees (collectively, “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind caused by their participation, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize; and (b) except where prohibited by law, consent to the use by Beasley Media, the Station, or any other participating station, or their designees or agents, of winner’s name, hometown, likeness, statements and other personally identifiable information for promotion, advertising and marketing purposes in any media throughout the world without additional consideration and consent or prior review.  To the extent not prohibited by law, winners also agree to provide Beasley Media with an interview, which may be used in connection with the Promotion.  Promotion Entities are not responsible for incorrect or inaccurate transcription of Entry information, or for any human or other error, late, lost, or misdirected mail, or any other error or malfunction related to or resulting from participation in this Promotion.  CAUTION:  ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTION ENTITIES RESERVE THE RIGHT TO COOPERATE IN THE PROSECUTION OF ANY SUCH INDIVIDUAL(S) AND TO PURSUE ALL REMEDIES TO THE FULLEST EXTENT PERMITTED BY LAW.  Failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  If for any reason the Promotion is not able to be executed as planned (in whole or in part), due to computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures, or any other causes which in the opinion of Administrator and/or Sponsor, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Promotion, Administrator and/or Sponsor reserves the right at their sole discretion to disqualify any suspect entry or Contestant and to cancel, terminate, modify or suspend the Promotion. In the event of any cancellation, termination or suspension, notice thereof will be posted at the stations website and/or the event(s) and determination of the prize winner will be made, from among all eligible, non-suspect entries received as of the date of the termination, cancellation or suspension, as Administrator and/or Sponsor determines in their sole discretion.  Entries not complying with all rules are subject to disqualification.

b.                  Payments of all federal, state and local taxes are solely the responsibility of the winner.  The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number or the equivalent for receipt of any prize valued at $600 or more or for any prizes awarded by the Station (or any other commonly owned stations in the Station’s market) in a calendar year with an aggregate value of $600 or more.  Failure to submit a completed Form W-9 or equivalent upon request will result in forfeiture of the prize.  Such winnings of $600 or more will be reported to the IRS.

c.                   Participation in the Promotion and/or acceptance of prize constitutes entrant’s and/or winner’s agreement to release, discharge, and hold harmless HipCricket Corporation, Beasley Media, the Promotion’s sponsor(s), the participating radio stations, their licensees, and each of their respective parent, subsidiary and affiliated entities, their advertising and promotional agencies, prize suppliers, and participating sponsors, and their respective officers, shareholders, directors, employees, agents and representatives and all of their successors and assigns from and against any and all claims or liability arising directly or indirectly from the prize and participation in the Promotion, including but not limited to any claims based on publicity rights, defamation, or invasion of privacy and prize delivery.

d.                  Beasley Media’s failure to enforce any term of these Official Rules shall not constitute a waiver of this provision.  If due to circumstances beyond the control of Beasley Media, including any force majeure event or other event of local or national importance, any segment of the Promotion is delayed, rescheduled, postponed or cancelled, Beasley Media reserves the right, but not the obligation, to cancel, terminate, suspend, or modify the Promotion and shall not be required to award a substitute prize. Further, the Released Parties are not responsible if any part of a Promotion prize that cannot be awarded due to acts of God, acts of war, natural disasters, weather, acts of terrorism, or other factors beyond the Released Parties’ control.

e.                   Contestants understand, acknowledge and agree that the Released Parties shall not be liable for losses or injuries of any kind resulting from the rejection of an entry given Beasley Media’s belief that the contestant was abusing or tampering with the Promotion entry process in any manner or due to any technical malfunction of the telephone or network transmission line or any entries that are late, delayed, garbled, incomplete, misdirected, lost, corrupted or otherwise not in compliance with the rules or applicable law.

f.                   The Released Parties are not responsible for:  (i) typographical or other errors in the printing, the offering, or the administration of the Promotion or in the announcement of a prize; (ii) incorrect or inaccurate entry information, human error, failure, or omission; (iii) unauthorized human intervention; (iv) entries not received due to difficulty accessing the internet, service outage or delays, equipment malfunctions, disconnections, or other technological failures, dropped calls or interruptions; (v) misdirected, misdialed, incomplete, incorrect, or late mobile text or website entries; and (vi) any cancellations, delays, diversions, or substitutions or omissions whatsoever by any transportation providers or any other persons or entities providing any services to winner(s) including any results thereof such as changes in services or location necessitated by same.

g.                  Any disputes that may arise hereunder shall be governed in all respects by the laws of the State of Florida without regard to the conflicts of laws principles of any jurisdiction.  Venue with respect to any such disputes shall be had in the state and federal courts of the State of Florida.
